State Of Texas Suing Biden Admin Over ‘Unlawful’ Migrant Release Policy

A lawsuit contesting the “unlawful” migrant release program has been filed by the State of Texas against the Biden administration.

Texas wants to do something about the chaotic situation on the U.S.-Mexico border.

On Friday, hours after the Title 42 public health order was dropped, Texas Attorney General Ken Paxton filed a lawsuit in federal court to stop the Biden administration from implementing a policy that would allow for migrants to be paroled into the U.S. without court dates.

Paxton, who has filed more than a dozen lawsuits contesting the border and immigration policies of the Biden administration, asked a judge on May 10 to temporarily halt the implementation of one such program. Alabama, Arkansas, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Ohio, South Carolina, Tennessee, and West Virginia were among the 12 states that joined the case.

Overcrowding at Customs and Border Protection facilities might result in migrants being freed on humanitarian parole “with conditions” under the new policy. Without an alien registration number or a court date, migrants released under the memo would have to contact Immigration and Customs Enforcement (ICE) to schedule an appointment or obtain a Notice to Appear in court.

The lawsuit argues that the administration violated the Administrative Procedure Act (APA) by not providing a notice and comment period and that the policy will cause the states “immediate and irreparable harm for which it has no adequate remedy at law.”

The policy faced a separate lawsuit from Florida Attorney General Ashley Moody, arguing that it was “materially identical” to a “Parole + ATD” scheme that had been barred in a previous lawsuit in March.
